2. TERMS OF SERVICE
1. Acceptance of Terms & Nature of Business
Agreement terms binding all site users and prospective business applicants.
Definition of business entity: SALLEH WHITE VENTURES operates strictly as a digital real estate asset developer and lessor, not an advertising agency, lead-broker, or marketing consulting firm.
2. Digital Billboard Asset Leasing & Ownership
Property Ownership: Full legal and technical ownership of all web assets, domains, ranked content, media assets, and phone-tracking infrastructure remains exclusively with SALLEH WHITE VENTURES.
Lease License: Lessees acquire a temporary, revocable, non-transferable license to display branding and receive incoming calls/inquiries generated by the asset during the paid term.
3. Performance & Lead Volume Disclaimer
No Volume Guarantees: Express statement that SALLEH WHITE VENTURES provides digital positioning and contact infrastructure only. No guarantees or representations are made regarding specific numbers of phone calls, web leads, revenue generated, or customer conversion rates.
Consumer Action: The lessor assumes no liability for consumer behavior, local market fluctuations, seasonal demand shifts, or the lessee’s internal sales close rate.
4. Territory/Location Exclusivity & Billing
Exclusivity Terms: Exclusive rights apply to a single designated service niche and geographic territory/location for active, paying lessees. A one-time onboarding and exclusivity fee applies.
Flat Rent Obligations: Fees are billed on a fixed, flat-rate monthly basis. Non-payment results in immediate termination of routing infrastructure and forfeiture of market exclusivity.
5. Acceptable Use & Conduct
Prohibitions against reverse-engineering, attempting to tamper with search rankings, or using the web properties for unlawful, fraudulent, or deceptive commercial practices.
Lessee responsibility to maintain valid business licensing and handle incoming customer inquiries professionally.
6. Limitation of Liability & Indemnification
Cap on liability restricting damages exclusively to fees paid by the lessee within a specified billing window.
Lessee agreement to indemnify SALLEH WHITE VENTURES against third-party claims arising from the lessee's commercial operations, customer disputes, or service delivery.
7. Cancellation and Refund Policy
Lessee can cancel subscription by contacting [email protected] at least 14 days prior to the renewal date. Lessee to make sure receiving return reply on confirmation of the request.
Payments made to SALLEH WHITE VENTURES are strictly non-refundable.
Lessee retains full access to the ranked website or automated system until the conclusion of the current paid billing cycle, after which services will automatically terminate unless renewed.
8. Governing Law & Dispute Resolution
This Terms of Service shall be governed by and construed in accordance with the laws of Malaysia.
Any dispute arising under or in connection with these Terms shall be resolved amicably between the parties
If unresloved, the dispute shall be submitted to arbitration online or at a mutually agreed venue, with the award being final and binding.
